WASHINGTON (AP) - President Bush has asserted executive privilege to prevent Attorney General Michael Mukasey from having to comply with a House panel subpoena for material on the leak of CIA operative Valerie Plame's identity.

A House committee chairman, meanwhile, held off on a contempt citation of Mukasey - who had requested the privilege claim - but only as a courtesy to lawmakers not present.

Among the documents sought by House Oversight Chairman Henry Waxman are FBI interviews of Vice President Dick Cheney.

They also include notes about the 2003 State of the Union address, during which President Bush made the case for invading Iraq in part by saying Saddam Hussein was pursuing uranium ore to make a nuclear weapon. That information turned out to be wrong.

Waxman rejected Mukasey's suggestion that Cheney's FBI interview on the CIA leak should be protected by the privilege claim - and therefore not turned over to the panel.

"We'll act in the reasonable and appropriate period of time," Waxman, D-Calif., said. But he made clear that he thinks Mukasey has earned a contempt citation and that he'd schedule a vote on the matter soon.

"This unfounded assertion of executive privilege does not protect a principle; it protects a person," Waxman said. "If the vice president did nothing wrong, what is there to hide?"

The assertion of the privilege is not about hiding anything but rather protecting the separation of powers as well as the integrity of future Justice Department investigations of the White House, Mukasey wrote to Bush in a letter dated Tuesday. Several of the subpoenaed reports, he wrote, summarize conversations between Bush and advisers - are direct presidential communications protected by the privilege.

"I am greatly concerned about the chilling effect that compliance with the committee's subpoena would have on future White House deliberations and White House cooperation with future Justice Department investigations," Mukasey wrote to Bush. "I believe it is legally permissible for you to assert executive privilege with respect to the subpoenaed documents, and I respectfully request that you do so."

White House spokesman Tony Fratto said Bush invoked the privilege on Tuesday.

Waxman said he would wait to hold a vote on Mukasey's contempt citation until all members of the panel had a chance to read up on the matter.

The Bush administration had plenty of warning. Waxman warned last week that he would cite Mukasey with contempt unless the attorney general complied with the subpoena. The House Judiciary Committee also has subpoenaed some of the same documents from Mukasey, as well as information on the leak from other current and former administration officials.

Congressional Democrats want to shed light on the precise roles, if any, that Bush, Cheney and their aides may have played in the leak.

State Department official Richard Armitage first revealed Plame's identity as a CIA operative to columnist Robert Novak, who used former presidential counselor Karl Rove as a confirming source for a 2003 article. Around that time Plame's husband, former Ambassador Joseph Wilson, was criticizing Bush's march to war in Iraq.

Cheney's then-chief of staff, I. Lewis "Scooter" Libby, also was involved in the leak and was convicted of perjury, obstruction and lying to the FBI. Last July, Bush commuted Libby's 2 1/2-year sentence, sparing him from serving any prison time.

Libby told the FBI in 2003 that it was possible that Cheney ordered him to reveal Plame's identity to reporters.

who cares who outed her? even if it was cheney, there are probably reasons that the american press doesn't need to know! and ya know, if ya tell a democrat something, then the press gets it within seconds.........

While your constant & pathetic tirades aimed at President Bush are often very amusing for their pettiness, they would have at least a little bit of credibility if you would acquaint yourself with a few facts about them every now & then…

Everybody who took the time to inform themselves already knows that Valerie Plame was not a covert CIA operative as she claimed, her husband was totally wrong when he denied that Iraq was attempting to purchase yellow cake uranium from Niger (you know, the same stuff that we just removed 550 tons of from Iraq and relocated to Canada) and that it was Richard Armitage who first leaked her name, but nobody is after him…

As for Executive Privilege, it is a vital protection that any President needs to ensure that they get frank, honest & heartfelt advice from their key advisors who otherwise would be biting their tongues, watering down their advice and sanitizing their opinions for fear of future prosecution or being forced into invasive & potentially damaging testimony in open court.

A Chief Executive of the most powerful Nation on this planet absolutely needs the honest opinions and best possible advice from their cabinet as they make historic, World changing life or death decisions that often affect tens of millions of people all around the Earth.

The Valerie Plame incident was so important that the president said that whoever leaked this info would answer to him. Well, you saw the result of that. Cover-up and pardon, of which GWB was the major player. Executive privilege does not give a president the right to lie and deceive the public and then hide the truth behind "executive privilege".

I don’t know CaseyJones. I think you are in a rut of Bush hate. It may be time to seek professional help at this point buddy.

Hacksaw is correct in his response. For starters it actually turned out to be Richard Armitage who did the leaking. I understand that the media under reported that fact, but they appear to be stuck in the same rut. If it doesn’t sell the story that Bush equals Hitler, they tend to ignore facts.

It is time to let go of your Bush hate. He is going to be out of office soon, and then what will you do. Get help now, before the election, or turn your hate toward the Congress (with their 9% approval rating it should be easy to do).

if our president is supposed to be totally transparent, then why does the "executive priviledge" even exist? come on now casey, SOME things are just not for public knowledge & you KNOW that.

I`m sure he knows the truth and is hiding it from the public. If you deem the incident so menial, why would it be classified ? The bottom line is, the TRUTH would expose his` lack of creditability one more time. The people are getting a daily dose of lying and deception and they are getting sick and tired of it. He is flip-flopping on his` own word.

Princess - You keep playing the same broken record but it doesn`t restore integrity or respectability to the White House. As long as the president continues to lie and cover up lies and has the support of you who won`t seek the TRUTH, this shameful charade goes unchecked and the president gets closer and closer to assuming dictatorial powers. When the executive branch thumbs it`s nose at the legislative branch, our` system of government breaks down and monarchy ensues.

The Good Lord gave me the intelligence to be a liberal who still has the ability to think and question anything I feel is wrong. That`s basically what a conservative doesn`t have. They are mandated to just follow along, never questioning what they are told and covering each other`s ass, right or wrong.There is hope in the power of prayer. I am 70 yrs. old and I have never seen our country in such dire straits as it is today. I was born in W.Va., Grew up in Pa. with Bobby Vinton, and ended up in Oh. Back then, when you graduated from high school in W.Va.,Pa.,or Ky., you received a diploma and a road map to Ohio. I grew up in the 50`s and 60`s, so I know what really good times in our` country were. GOD BLESS AMERICA AGAIN !
