FROM DETROIT (AP) -- A judge has ruled that the Detroit City Council
cannot hold a hearing to remove Mayor Kwame Kilpatrick from office.

Wayne County Circuit Judge Robert Ziolkowski (Zill-KOW'-ski)
said Monday afternoon that the city charter does not give the
council power to force out Kilpatrick.

The council accuses the mayor of violating the charter by not
revealing a confidentiality agreement linked to an $8.4 million
settlement in a civil case.

A second removal effort by the council rests with Governor
Jennifer Granholm, who will preside at a Sept. 3 misconduct hearing
targeting Kilpatrick.

The mayor also faces 10 felony counts in two criminal cases.

FROM SOUND OFF:

The City Council's attorney's will appeal this ruling. Their ability to remove Mayor Kilpatrick now rests in Governor Granholm's hands. You have to wonder if today's ruling will effect her decision on September 3rd. If the Mayor is eventually convicted of the one of the felonies he faces, the city charter does allow for him to be removed from office.

Right now it looks like the only way the Mayor gets out out office is if he resigns... is convicted of a felony... is forced out by the Governor... or loses an election.

One judge ruling as he should, now two ruling in favor of the kawameee. I wonder how long killcowSKI has been a good ol boy on the mayors team. At least there is one honest judge in deeetroit.
Lansing should move these cases to Oakland or Lapeer County. We will give his dishonor a fair trial....

Well I cant say i am surprised by this ruling.

Re Write the city charter and this time in PLAIN english so that we dont need an army of lawyers and judges to decipher it .

Political scandel is nothing new, but at least other politicians who have found themselves in an embarrassing situation will save their families the embarrassment by steping down and letting their scandel handled privately. Unfortunately for the Kilpatrick family not only has Kwami not resigned, it has led to his whole family being dragged through the mud. First his wife and children, then his sister now his father. What motivation does he have for not stepping down. Does he think that the city respects him for not handling this in a private matter. The longer he stays in office, the more dirt they are going to find out about him and his family. If (and that's a big if) Kwami was to be found not guilty, he could run for office again. For someone who claims to love the city of Detroit, he is doing more harm than good. What positive things Dennis Archer as well as Kwami is now gone down the tubes and the city of Detroit is again in national headlines about a corrupt mayor.

OH COME ON, THE CITY COUNCIL IS THE CITY'S VERSION OF THE FEDERAL GOVERNMENT,S CONGRESS, AND SENATE, WHICH HAS THE POWER TO VETO OR CHANGE WHAT THE PRESIDENT OF THE COUNTRY WANTS, GET THIS CORUPT MAN OUT OF OFFICE, WITH THE PLEA DEAL THAT KYM WORTHY DENIED TO ACCEPT, HE ADMITTED HIS GUILT, AGAIN GET HIM OUT.

First of all I would like to say:
THANK YOU DETROIT CITY COUNCIL for trying!!

I believe that this process will have to have it's day in court and Kwame will have to "actually" be convicted of a Felony (which by the way is just a matter of time) whether it is the pending assault charges (which are undeniable) or pending Felony counts. I do not believe that Kim Worthy would raise these Felony charges against the Mayor if she did not have the documentation and testimonies needed to prove her case against the Mayor.

I also believe that Govenor Granholm will not remove the Mayor - she will use some kind of an excuse to not get involved !!

Well, I guess we will just have to wait and see.

Alabama attorney Jim Parkman is no longer with Detroit Mayor Kwame Kilpatrick’s legal team, a spokesman said today.

Kilpatrick spokesman Marcus Reese issued a statement tonight, saying: “The Mayor has put together a legal team of various backgrounds and experience designed to play different roles during different stages. We are now moving into another phase, the Mayor’s legal team will reflect this transition accordingly.”

City Council needs to IMMEDIATELY draft a new Charter even though it can't be voted on until 2009 safe guards need to be taken now to prevent this happening in the future, although I believe KK has made his mark and he is going to be the MOST CORRUPT Mayor in Detroit's history. Jenny around the block will not do anything she hasn't done anything for this State in how many years but turn it into a wasteland. I'm wondering if Jim Parkman quit because he maybe does have some principles and couldn't defend KK's illegal actions anymore. This Jim Thomas has shown what a low life scum sucker he is by editing that tape and swearing up and down he never touched it. I have to admit when I first heard it I had doubts until we heard the true version in court. I think he should be fined for being a dumb hillbilly.

even though i live in the burbs, i really think the mayor needs to step down. he is making this state look bad, it's time to move on and make this state better and he isn't helping matters. it's time for him to go!!

Why is it that when you post a comment on the air you do not show what was really in the post?
You left out most of justice - prevails post, I would like to know why?
As far as Kwame I think that Governor Granholm will not remove the Mayor, she just has no back bone. He will not be convicted of any felony, the Judge is a Kwame supporter, I do want to thank Kim Worthy for all her hard work she is a good and honest person and at least Detroit has her.

kym worthy isnt a hard worker and this great person yall clame her to be. Detroit police have MURDERED 12 people since the perjury charges were filed and out of that 12, 7 were unarmed one body was found under a police car with his bike on the other side. she hasnt charged one cop with non of these MURDERS. she is spending the most money in Wayne COUNTY HISTORY on a trial. and this is a perjury case. perjury about an affair that had nothing to do with the case. she allowed her office to allow a cop and an informant to lie on the stand so they could convict an alledged drug dealer then rewarded the lyers 10% of the alledged drug dealers assets. then they told the judge what they did and instead of Kym letting the guy out of jail or charging the cop and informant and prosecuter with perjury and obstruction of justice she just suspended her with pay. but this is who yall love so much a women pulling all of the stops to embarress our mayor and our city and stop prsecuting the real criminals. yall need to open yalls eyes. she hates the mayor. never supported him in fact fired her political consultant because he was working with Kilpatrick also. they werent running for the same position so why did she do that. Watters works for Kym Worthy amd Mildreg Gaddis and kym are childhood friends.

Remember, all along, Granholm said she will not do anything unless KK is proven guilty by the courts. Well... by September 3rd, I'm sure that will not happen. Nothing will be done.. as usual.

I think it`ll come down to being convicted of a felony. In the mean time we have a local group running an ad to support KK. Why are they wasting their money? His rights haven`t been taken away and he will have his days ( plural ) in court.

"A spokesman for Citizens for an Honest Government said Tuesday the ad is a reminder that Kilpatrick has constitutional rights and should have his day in court.

Adolph Mongo also complains that the mayor is being treated by prosecutors and some judges more harshly than an average person charged with similar offenses."

All I can say to Mongo is with greater responsibility comes greater accountablility and greater punishment. Common sense.

no former the law is the law and everybody has to abide by the law including the law. Kym is spending the most money in wayne couty history on this trial. she doesnt do that for all other cases. she doesnt hire 7 more prosecuters for one case. she doesnt put her top homicide investigators on non violent trials. he is not being treated like joe six pack because if joe six pack would have done what they clame the mayor has done wouldnt even gotten this far. she probably would be to busy prosecuting KILLER COPS at least we hope she would
