Hey, 
I was at the hoedown tonight, and drove in a van with a bunch of people. I was planning on having a few beers, as I am 22 and legal to drink, and therefore did not want to drive. As we parked on Cobo Roof, several people in the car, there was at least ten people in the van, started bringing out alcohol and pouring it in containers. My phone rang, and I answered it. It was my mom, she just got her surprise mother's day gift. Anyways, I sat down because I could not get out of the car. Caught up in conversation, not a minute later a cop was pulling me out of the car. I had to put my hands on the hood. I thought I was fine, didn't drink anything and had nothing on me.
However, they only stopped three of us. The two other people were brothers and the age of 16 and 19, and were the owners of the van. The both had been drinking. The 19 year old was the driver and only had a sip, blew a .01. But as the gave him the breathalizer they said the batteries were dying and they did, so I don't know if they got a real reading. They did not give the 16 a breath test, and wrote them both for MIP's and called their parents.
Now for the fun part. They wrote me up for furnishing alcohol to minors, and I didn't buy, don't know where they got it from, they had it mixed in a coke bottle. Also, the wrote me for disorderly conduct and drinking jack and coke in public. So thats two tickets for being sober. I asked the officer politely if I could speak without being disrespectful and she said yes. I asked her if she seen me with any alcohol or drinks, and she said tell it to the judge. All the cops told me to tell it to the judge, and they would not give me a breath test to show I was sober and would not let me talk.
Also, on my tickets they did not write their badge numbers or print their names, I got a signature I can't read. So is that ticket valid?? Any advice on what to do??

File a formal complaint with the PD then get yourself a good lawyer go to court and fight it.

If you are white then everything will be OK.
If you are not... then you will be jailed without reason and probably charged with a long list of offenses.
This is how our legal system works, just ask some of our fellow bloggers like SEEDUB.

you know being an adult you could also faacce other charges coming from the fact you had a 19 year drinking.

drinking in public is also against the law, maybe you need to think before you drink or be with others underage or drinking in public.

Here's my take while I sit here in Germany drinking one of Germany's fine brew........First of all you had beer where there's minors in the same vehicle and I'm sure they weren't in a container. It doesn't matter if he blew a .01 or 3.5, he had a drink under age. Can't get around that one. Another question is why were you on top of Cobo Hall? To drink beer? or something else?

Sorry dude, if you have a case take former Detroiter's advise. But remember you're underage friends will be sucked into it and you don't want them to pull a Kwame and lie under oath for a few beers.
Just my opinion.

Just to let you all know, there was no beer! Also, I am white and I now have a good lawyer now. The minors had the alcohol concealed in back backs and in the center console of the vehicle. I had no idea. The alcohol did not come out until we parked, and I didn't even make it out of the car in order to walk away. I had no part in it, and was just hitching a ride. 90% of the alcohol was unopened, and I was sober, and the only kid who took a breath test had a sip, which I did not know. I am a straight A student, I drink maybe once every two months, and if I drink its one beer. I volunteer at Children's Hospital every week, and have never been in trouble. My only worry is that I am going into teaching and do not need giving alcohol to minors on my record.

OK, Now if I was a cop and you just told me what you wrote today and what you wrote 12 hours ago, they are different. It doesn't matter if you werent a part of it, you were there. You sound like a smart kid, why were you in a vehicle if you didn't know them? Your story is very confusing and it looked like it changed. Good luck and make sure your story is tight.

1. Don't Hang around under aged kids.
2. Never have open intoxicants in a car, all it takes is one cop to screw your eye balls out. With open booze in a motor vehicle you gave them all the ammo they needed.
3. Never hitch a ride.
4. Show up for court, and pay the fine! Tell the judge what happen, most likely they will make you pay a fine, all they want is your money. Get rid of your lawyer, so he won’t be in your pocket too. Be proud, now you can officially, say you helped Kwame get laid.

SEEPUTZ, we disagree with you totally. It doesn't happen that way in court, and to put that bravado out, is incorrect. Let me give you an example: My wife's 2nd cousins daughters husband's uncle Leo (by marriage only) never hung around teenagers except my oldest brothers wifes girlfriends son Lucas, and Lucas was an idiot. He did not have a drink, was not drunk, and was not driving, but he told the officer the truth, went to court and was given the max statement. And to make the matter worse, he was a lawyer himself.

Yea, I figured It all depends on the judge I get. I do have a pretty good lawyer, he got someone off for murder and a guy off for setting fire to his own yacht for insurance fraud who was caught in the act. He is a family friend and says there is a good chance he can get me off. I was just in the wrong place at the wrong time, I don't get away from work and school much, and don't hang out with the party crowd. I appreciate all the comments good or bad, and like the Kwame jokes. I was just wondering if anyone knew if a cop had to write his or her name down and badge ID on the ticket in order for it to be valid, my lawyer said it doesn't matter. I am definitely going to try and fight this, even though I have the worse luck ever. For example, two months ago I was in a cast, broke my wrist really bad. I had a pin slip and pierce through my skin one morning, which really hurts, I went to leave school to go see my surgeon and my truck was stolen, and then my great grandma died all on the same day. The next day my dog died as well, and my cat the same week. I have also had my laptop stolen while volunteering at the soup kitchen.

Keep us posted on what happens. I bet the cop won't show up, if he does they will fine you.
I'm sure a lawyer can get you out of this mess, with minimal damage. Anything short of being locked up is a win.

When you come down to court go by the Joe Louis' fist, and rub it three times. It'll get rid of your "bad luck". Just try it, it works! In the Big city a good right Jab fixes a lot of problems. LOL

If you get real lucky , by the time you go to court , both officers will be layed off , fired , or suspended , in which case , your lawyer will move for dismissal . Good luck .

I went through a similar situation 20 yrs ago. My friend and I went to Eliza park on 5 mile after work since we worked right down the street. We were playing Frisbee waiting for his g/f to meet us and then off to a concert at the Joe. All of a sudden 3 cop cars came flying in and everyone took off. Well, except us and a few others. We just kept playing frisbee wondering what's going on. They called us over and arrested us saying we were selling drugs. We had nothing on us, we were not even drunk. They gave us tickets once we were in jail that said they found LSD on us. It was all bogus! We did nothing wrong! My parents hired a lawyer and all she did was stand there. The cop lied in court and we were put on probation for a year. If we stayed out of trouble, it would be removed from our records. It was all lies, we did nothing wrong and spent the night in jail instead of being at the concert. Our g/f's had no idea what happened to us. They towed his car as well.
What I learned is to be aware of where you are (that was a known drug park) and who your with. If your riding with someone, ask questions before you get in the car such as, Do you have a lic, is this your car, how old are you, do you have anything illegal in the car. An easier way is to just not hitch a ride with people you don't know that well. Good luck and I hope you have a better lawyer than I did!

I have talke to my brother in law who is an attorney, you have a good chance to fight this, officers must identify themselves on the ticket, no matter what.

I had gotten a ticket about 5 years ago for running a stop sign by motor city casino ( which I did run, my bad) the officer did the same thing left out his badge number and name. I fought it and won.

Engel what you need to be doing is writing country songs. Your ealier post has all the ingredents.

For example, two months ago I was in a cast, broke my wrist really bad. I had a pin slip and pierce through my skin one morning, which really hurts, I went to leave school to go see my surgeon and my truck was stolen, and then my great grandma died all on the same day. The next day my dog died as well, and my cat the same week. I have also had my laptop stolen while volunteering at the soup kitchen.
