Let's think briefly about  AUTO INSURANCE...the State says you MUST have it, and then gives the Ins Co.s free authority to set their own rules, and rates...due to their financial "requirements", owing to costs, type of coverage, inflation, etc...

Case in Point:: - My Beloved Wife, in  my Beloved  ALMOST new truck, in an unbeloved  traffic jam in Gaston Co., Christmas Eve, 2006 - She was already STOPPED in the inside Emergency Lane (left side),  - due to some fool causing an earlier slowdown/ minor wreck  -somebody couldn't wait to pee, I guess  -this was a full minute BEFORE  when she was twice hit from behind, with one going down the passenger side of my vehicle (I was not with her and her sister) -

For the Record: Neither my Wife nor I have ANY points on our State Driving Licenses -

MY Ins co., which rhymes alot with GEICO (they do give excellent rates) -is "A"

Party 2, whose Ins Co. rhymes alot with GMAC/Integon -is "B"

Party 3, whose Ins Co. rhymes alot with California Casualty-is "C"

After almost a year and a half, they have  "reviewed" my claim.....

"A" was willing to repair my truck, minus Towing Package and new tire (Factory Equipment).....to be fair, they didn't SAY my Collision would triple, but why the hell should I pay for it?

"B" and "C" are going around about "WE hit him, but HE hit your truck," etc...and WE hit your truck, but that's because HE hit US!.....Golly Gee.....What To Do?

OH, but wait! - "B" said an "unidentified vehicle" forced him out of his lane! - "C" picked up on that pretty quick, too, obviously no fool HE! - so now these triumvirates of Justice and the AMERICAN WAY  (pre-paid, no less) have decided there will be NO PAYMENTS rendered,  to ANYBODY, because they can all blame it on the "unidentified vehicle"!!!!....It was a full 4 months later before this "mystery vehicle" made an appearance ( by "B"'s "verbal account).....

The attending OFFICER at the SCENE called the Ins Co.s involved, left them the facts, contact info,etc...never even got a callback, nothing.....

Due to Familial business matters, I've spent too much money lately on $85.00/ half hour  (read 20 min )  USELESS Lawyers...Back in the good old days, you didn't pay a Lawyer (like a mechanic) until he did what you paid him to do...No real hope there - Talked to the NC Insurance Commission - they admitted their hands are basically tied, until a FEDERAL amount of cash is involved.....WTF?

Anybody out there have reasonable advice, or the number of a decent Lawyer in Gaston Co?.....

There is an Ins. Industry term called  "injury and several" to cover these situations, but apparently they don't  even want to split the LEGAL Liability, better to keep the BUCKS in the Family,  I guess.....

Now that is something. I wish I could say I do not believe it, but this day in time, it is the victim that truly pays. I do not know anyone in Gaston County. If I did I would certainly pass you the info.

I do not see a way to deal with all of this without having an attorney. Although you did not mention an injury, Person Injury attorney's DO give free initial consultations and they deal with this kind of crap all the time. That is their specialty. Just call and ask. If they say they have a charge before they do anything, move to the next one.

Bro, I drove that truck for 26000 miles without a ROCK CHIP in the paint - I know they'd fix it as "good as new".....but it's just not the same is it? - I took pics, got quotes, E-mailed and FAXed all that crap, just as they asked.....

DW45, I know "a little" what you are going through! My daughter had an accident, in which her car collided with the rear wheel axle of a "duelie". She was in a curve, her air bag deployed, her foot went through the floor of the car, and her driver's side window was shattered, either by her head or the truck? She crawled out of the "trunk" of her car with an obvious concussion, cut all to pieces by the glass from the window, foot messed up and knee from the floor, and bruised from the seatbelt and airbag deployment! Thank God for the airbag!!! Now, she was dazed and kept saying "I'm sorry", but when the police report came out, she wasn't charged with anything. Know why??? Well, (1)the EMS didn't take her to the hospital, (2) the "black box" that all newer vehicles have that the police can "plug into" and know your speed at the time of the accident and before, said the truck was going 73 mph in a 40mph zone, while her car was going 35 mph in the curve of the 40 mph zone! What happened? Her insurance paid for the truck to be fixed, and no insurance paid to fix her car! They said that "she" was "left of the line", which really seems incredible; could you keep a vehicle that big within a single lane in a 40 mph zone if you were going 73 mph??? I don't think so!!!

A little secret that I learned a few years ago when my husband was hit backing out of our driveway by some fool that came flying around the corner. The other guy's insurance company called to get my husband's "statement" when, in reality, that statement is the insurance company's ploy to get you to admit that there may have been something that you, the victim, could have done to avoid the accident. In NC, once you admit to at least 1 percent of the blame, you get nothing. You cannot file against their insurance and they cannot file against yours. Everybody collects from their own insurance. This information came from an attorney. So, if you are ever in an accident, don't ever admit that maybe you could have done something to avoid the accident. When an accident happens and the insurance company makes claims that you did this or you did that...if there is no police report saying that it happened that way, fight it! Don't admit any guilt! And most of all...don't be intimidated. Unless you accept what the insurance company tells you and "sign on the dotted line", there is a very good chance that you will come out in your favor. They want these cases closed as soon as possible but are prepared to wait you out. So it will definitely be a waiting game.

It's a shame nowadays, you can't go 'cross towm, look the sonuvabitch in the EYE, and POLITELY bellow "WHAT'S THE PROBLEM, MAN??? - after you let go of their throat, you MIGHT get an answer.......

Do 2 patients in the same room count as "co-defendents"?

DW45 I think that I can solve your problem.

First, let's start with your lawyer. Write him your letters and ALWAYS send them certified mail with an answer back and KEEP EVERYTHING. Then call the N.C Carolina Bar Association in Raleigh at 919-828-4620 Ext 260. That is division of Public Liaison. Talk with them. They will call your lawyer and ask him questions. If he fails to do his job, you can take him before a four judge panel and get him to explain to them his actions. Believe me, you now have his attention. I have done this and won.

ALWAYS use certified mail with an answer back and keep everything everything. Then do the same thing with the insurance companies. Then contact the Insurance Commissioner's office and then go to the Attorney General's office. Make phone calls and get names and then certify letters to them and document a path of their stupidity.

Then take them to court and I can show you how to do that yourself with little money out of your pocket. Phone calls and stupid conversations get you no where. You have to build a paper trail against them and ask the right questions to paint them into a corner.

Damned Shame.......I wouldn't mind paying for it if was there when I needed it!
